Section 8 Realtor

(post by BT) I recently received a phone call from a rogue agent with whom I worked on a deal about a year ago. She asked me to see if I had any Landlords that accept Section 8 (subsidized housing paid by the city). “Not at this time”, I tell her. “Well, Hon”, she says, “If something comes along let me know, because it’s for me. “

Huh?! Now, this just drove me nuts! This crazy woman works for the Board of Education. She collects disability. She works as a Realtor “off the books”, cash only commissions. Now section 8?!! She only does rentals, no sales, because those larger commissions are paid by checks.

I know she posts “for rent by owner” apartments on the Multiple Listing Service (MLS), which you can only do legally with a written exclusive listing agreement from the owner, which she does not have, of course. Someone who did not earn the listing, and is not even a member of their local Real Estate Board, so they can hide the income! She works through another shady broker, who lets her post her fake listings on MLS under his name. These people make me sick! They live up to the negative stereotype of a dirty broker.

With pride, she was bragging to me about this, as if I were to say “congratulations, you’re so smart — you’re stealing from the government”. What a low-life! These are the crooks who give us the bad name. These are the whacko agents that my mother worked with for 20+ years? I can’t stand it. Maybe I’m not cut out to deal with these kinds of characters.

What I call a ‘drive-by shooting (photo)’… Obviously the Realtor took his time, NOT! Didn’t even bother getting out of his car. What kind of camera does he have? Never mind. Ridiculous.

  1. How can a realtor who has a written exclusive listing agreement from the owner to rent their property get a fee from the owner when it is a Section 8 rentor? The owner has to complete the forms, pay for the liscense and the property is put on a list by the Government for potential rentors. Is the owner still obligated to pay the realtor for a Section 8 rentor?

First, your question isn’t giving me all the details needed for a correct answer so my response might not be 100 % correct, but based on what you are saying, sounds like you are the owner and you agreed to pay the fee for your agent - which is great! But someone with a section 8 voucher came along and as part of that program, section 8 pays the broker commission… so you feel that the tenant is paying, so why should u pay? And you are correct. But to be fair, your agent must disclose to you that they are collecting from both parties and at that point it’s up to you to allow it. I don’t know the entire story so hard to answer. Keep in mind, this is a blog - they don’t give legal advice here ;)
